The controller of your personal data is Merktop LLC, a remote-first company incorporated in the State of Delaware, United States. You can reach our privacy team at privacy@merktop.com. If you are located in the European Economic Area or the United Kingdom and need to contact our EU/UK representative under Article 27 GDPR, please email privacy@merktop.com and we will route your request. The registered agent's address is available on request.
We collect (a) identification and contact data you provide when you create an account or contact us (name, email, business name, phone, billing address); (b) account data generated while using the platform (products, orders, catalogues, store configuration, logs and security events); (c) payment metadata processed by Stripe on our behalf — we never see your card number; (d) technical data automatically collected when you visit the site (IP address, device, browser, referrer, language) and (e) cookie data as described in our Cookie Policy.
We process your data on the following legal bases under Article 6 GDPR: (a) performance of the contract — to provide the Merktop service, deliver orders, host your storefront and bill you; (b) legitimate interest — to keep the platform secure, prevent fraud, monitor service performance and develop new features; (c) consent — for non-essential cookies, marketing communications and optional analytics. You can withdraw consent at any time with effect for the future; (d) compliance with a legal obligation — accounting, tax and anti-money-laundering recordkeeping.
We share personal data only with processors that act on our documented instructions under a data processing agreement: Stripe Inc. (payments), Railway Corp. and our cloud provider (hosting and backups), email delivery providers (transactional emails), Cloudflare (security and bot protection) and Google LLC (analytics, only if you consent). A current list is available on request from privacy@merktop.com. We do not sell your personal data and we do not share it with advertising networks without your consent.
Merktop is headquartered in the United States. When we transfer personal data of European residents outside the EEA we rely on (a) the EU-US Data Privacy Framework for certified recipients, or (b) the European Commission Standard Contractual Clauses (Decision (EU) 2021/914), supplemented where necessary by additional technical and organisational measures (encryption at rest and in transit, role-based access control). A copy of the safeguards is available on request.
We keep account data for as long as you maintain an active account, plus a reasonable archival period after closure to honour our legal obligations (typically seven years for US accounting and tax records under IRS guidelines). Marketing data is kept until you withdraw consent or unsubscribe. Webhook and security logs are retained for up to 12 months. Aggregated, non-identifying analytics may be kept indefinitely.
Under the GDPR and equivalent national laws you have the right to: (a) access your data; (b) rectify inaccuracies; (c) erase your data ("right to be forgotten"); (d) restrict or object to certain processing; (e) data portability in a machine-readable format; (f) withdraw consent at any time; and (g) not be subject to decisions based solely on automated processing that produces legal effects (we do not perform such processing today). To exercise any right write to privacy@merktop.com. We will respond within one month, free of charge, unless the request is manifestly unfounded or excessive.
If you are in the European Economic Area or the United Kingdom and believe your data is not being processed lawfully, you have the right to lodge a complaint with your national data protection authority (a current list is published at edpb.europa.eu). If you are in the United States, you may contact your state Attorney General. We would appreciate the opportunity to address your concerns first, so please consider contacting privacy@merktop.com before reaching an authority.
We use cookies and similar technologies on the website and inside the dashboard. A detailed list of every cookie, its purpose, provider and lifetime is available in our Cookie Policy. The consent banner shown on your first visit lets you allow or refuse each category individually. You can change your choices at any time from the "Cookie preferences" link in the footer.
The Merktop platform is not directed at minors under the age of 16. We do not knowingly collect personal data from children. If you believe a minor has provided us with personal data without parental consent, contact privacy@merktop.com and we will delete the information promptly.
We may update this policy to reflect changes in the service or in applicable law. Material changes will be communicated in advance by email or via a banner on the site.
